Private equity backed companies have done much to justify the industry's approach to continuing market turbulence. By demonstrating a level of flexibility and responsiveness not shown by listed corporates these companies and their private equity sponsors should feel cautiously confident when looking to their futures. Deal flow seems to be increasing with many transactions deploying novel structuring and increased levels of equity. Raising debt for new deals, however, remains stubbornly difficult. Following on from the success of our 'sliding doors' session last year, we will once again be exploring the ups and downs and dos and don'ts of internal procedures and tribunal proceedings.
Litigation involving investment funds has developed exponentially across the globe since 2008. Whether as a result of the fraud perpetrated by Madoff, the failings of fund (such as Weavering) directors or the overall economic meltdown, investors have found themselves holding shares that may variously be gated, suspended or sometimes worthless. Whilst much of this litigation has taken place onshore (primarily in the US), the offshore world has been at the forefront. The Funds Litigation Forum will examine the issues presently being thrashed out by the Courts, how regulators have responded to the crisis and what the industry thinks lies ahead. Russian issuers have led the way in 2011 in London IPOs, raising almost $2 billion USD through the first four months of the year and surpassing the total of $1.73 billion for all of 2010. Significantly, three of the recent IPOs (Nomos, Rosagro and Etalon) were from companies operating in sectors which were hit hard by the global financial crisis – banking, agribusiness and real estate development.
At this year’s conference, participants will look at how IPOs have priced in 2011 and hear about what criteria investors are focused on this year and learn about what other companies have done to secure the best valuation and IPO price performance in today’s markets.
